1. Overview

This website is operated by Bobyk Media Inc. ("we," "us," or "our"). Throughout the Site, the terms "we," "us," and "our" refer to Bobyk Media Inc. We offer this Site, including all information, tools, and products available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting madebytrev.com (the "Site") or purchasing any product from us, you agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced herein. If you do not agree to these Terms, you may not access the Site or purchase our products.

Please review our Privacy Policy, which also governs your use of the Site.

2. Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your province, state, or territory of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this Site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of our products, violate any laws in your jurisdiction (including but not limited to copyright laws).

3. Products and delivery

All products sold through the Site are digital goods, including but not limited to LUTs (colour lookup tables), Lightroom presets, wallpaper packs, and other downloadable files (collectively, "Products").

Products are delivered electronically. Upon successful payment, you will receive access to download your Products via a download link, email delivery, or account access. No physical goods are shipped.

You are responsible for downloading and storing your Products. While we make reasonable efforts to keep download links active, we do not guarantee indefinite access to download links, and we recommend you back up your files after purchase.

We reserve the right to modify, discontinue, or limit the availability of any Product at any time without notice.

4. Licence

Upon purchase, you are granted a non-exclusive, non-transferable, perpetual licence to use the Products subject to the terms below. You are purchasing a licence to use the Products — you are not purchasing ownership of the Products or their underlying intellectual property.

4.1 What you may do

  • Install and use the Products on devices you own or control.

  • Use the Products in an unlimited number of personal and commercial projects.

  • Use the Products in paid client work, including photography and video you deliver to clients.

  • Use the Products in work distributed publicly, including on social media, in advertising, and in broadcast or streaming media.

4.2 What you may not do

  • Resell, sublicense, rent, lease, lend, or otherwise redistribute the Products, whether modified or unmodified.

  • Share the Product files with any third party, including collaborators, employees, or contractors, unless they have purchased their own licence.

  • Include the Products, in whole or in part, in any preset pack, LUT pack, template, plugin, course, bundle, or other product you offer for sale or for free.

  • Upload the Products to any file-sharing service, torrent network, public repository, or cloud storage location accessible to others.

  • Reverse-engineer, decompile, or otherwise attempt to derive the source values of the Products for the purpose of creating a competing or derivative product.

  • Claim authorship of the Products or represent them as your own work.

  • Use the Products in any way that is unlawful, defamatory, or that infringes the rights of others.

4.3 Team and studio use

Each licence is issued to a single individual or business entity. If multiple individuals within an organization require access to the Products, a separate licence must be purchased for each. Contact us regarding multi-seat or studio licensing.

4.4 Termination of licence

We may terminate your licence without notice or refund if you breach any term of this Section 4. Upon termination, you must delete all copies of the Products in your possession.

5. Pricing and payment

All prices are listed in the currency displayed at checkout and are subject to change without notice. We reserve the right to correct any pricing errors, including after an order has been submitted, and to cancel affected orders with a full refund.

Payment is processed by third-party payment providers. We do not store your full payment card details. By submitting payment information, you represent that you are authorized to use the payment method provided.

You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.

6. Refunds

Because our Products are digital goods delivered immediately upon purchase, all sales are final and non-refundable.

We may, at our sole discretion, issue a refund in the following circumstances:

  • You were charged more than once for the same Product in error.

  • You did not receive access to your Product and we are unable to resolve the delivery issue.

  • The Product files are corrupt or incomplete and we are unable to provide working replacement files.

Refunds will not be issued for change of mind, accidental purchase, purchasing the wrong Product, dissatisfaction with the creative or aesthetic result, or incompatibility with software or hardware where compatibility requirements were stated prior to purchase.

To request a refund under the circumstances above, contact us through the Site within 14 days of purchase with your order number and a description of the issue.

Nothing in this section limits any rights you may have under applicable consumer protection legislation.

7. Compatibility and technical requirements

Software compatibility requirements for each Product are listed on its product page. It is your responsibility to confirm that a Product is compatible with your software and workflow before purchasing.

We do not guarantee that the Products will function with every version of every application, with third-party plugins, or with future software releases. Software updates released by third parties may affect Product functionality, and we are under no obligation to update Products for compatibility with new software versions.

Colour and tonal results will vary depending on your source footage or images, camera and lens, exposure, white balance, picture profile or colour space, monitor calibration, and editing environment. Product previews and sample images are illustrative and are not a guarantee of the results you will achieve with your own material.

8. Intellectual property

All content on the Site — including photographs, video, text, graphics, logos, page layout, and the Products themselves — is the property of Bobyk Media Inc. or its licensors and is protected by Canadian and international copyright law.

You may not reproduce, distribute, publicly display, or create derivative works from any Site content without our prior written permission. Viewing portfolio work on the Site does not grant you any licence to use that work.

9. Accuracy of information

We are not responsible if information made available on this Site is not accurate, complete, or current. The material on this Site is provided for general information only and should not be relied upon as the sole basis for making decisions.

We reserve the right to modify the contents of this Site at any time, but we have no obligation to update any information. You agree that it is your responsibility to monitor changes to our Site.

10. Prohibited uses

In addition to the restrictions set out in Section 4, you are prohibited from using the Site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any regulations, rules, or laws; to infringe upon our intellectual property rights or those of others; to harass, abuse, defame, or discriminate; to submit false or misleading information; to upload or transmit viruses or malicious code; to collect or track the personal information of others; to spam, phish, or scrape; or to interfere with the security features of the Site.

We reserve the right to terminate your use of the Site for violating any prohibited use.

11. Disclaimer of warranties

The Products and the Site are provided "as is" and "as available" without any representation, warranty, or condition of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, durability, title, or non-infringement.

We do not warrant that your use of the Products will be uninterrupted, timely, secure, or error-free, or that the results obtained from use of the Products will meet your expectations.

12. Limitation of liability

To the maximum extent permitted by law, in no case shall Bobyk Media Inc., its directors, officers, employees, or affiliates be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Site or any Product. This includes, without limitation, lost profits, lost revenue, lost data, loss of client relationships, costs of re-editing or re-delivering work, or any damages arising from the use of a Product in client or commercial work.

Where liability cannot be excluded, our total aggregate liability to you shall not exceed the amount you paid for the Product giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Bobyk Media Inc. and its directors, officers, employees, and affiliates from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms, your violation of any law, or your violation of the rights of a third party.

14. Third-party links

The Site may contain links to third-party websites or resources that are not owned or controlled by us. We are not responsible for the content, accuracy, or practices of third-party sites, and inclusion of a link does not imply endorsement. Any dealings with third parties are solely between you and that third party.

15. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed without affecting the validity of the remaining provisions.

16. Changes to these Terms

We reserve the right to update, change, or replace any part of these Terms by posting updates to the Site. It is your responsibility to check this page periodically. Your continued use of the Site or purchase of Products following the posting of changes constitutes acceptance of those changes.

17. Governing law

These Terms and any separate agreements whereby we provide you Products shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.

18. Entire agreement

These Terms, together with our Privacy Policy and any policies posted on the Site, constitute the entire agreement between you and us and govern your use of the Site and Products, superseding any prior agreements or communications.
